Terms of Use
Your usage of this website means acceptance of our Terms of Use.
This is an agreement between you and Watu Technology
You hereby represent that you are at least 18 years of age and that you have attained the age of majority country in which you reside, and that any information that you submit in Watu Technology is correct.
How Watu Technology may modify this agreement
Watu Technology reserves the right to change the terms, conditions, and notices under which it offers the Watu Technology, including any charges associated with the use of the Watu Technology Website and services. You are responsible for regularly reviewing these terms, conditions and notices, and any additional terms posted on Watu Technology Website. Your continued use of the Watu Technology Website after the effective date of such changes constitutes your acceptance of and agreement to such changes.
The Watu Technology Website may itself contain additional terms that further govern use of the Watu Technology Website, including without limitation, particular features or offers.
No commercial, unlawful or harmful use of the Watu Technology Website
You will not use the Watu Technology Website in any way that is unlawful, or harms Watu Technology, its affiliates, resellers, distributors, service providers and/or suppliers.
You may not use the Watu Technology Website in any manner that could damage, disable, overburden, or impair the Watu Technology (or the network(s) connected to Watu Technology) or interfere with any other party’s use and enjoyment of the Watu Technology Website.
Spam is prohibited and causes damage
You will not use the Watu Technology and partner servers to transmit, either directly or indirectly, any unsolicited bulk e-mail or unsolicited commercial e-mail.
If your use of the Watu Technology Services includes e-mail related services, then Spam filtering technology or other measures shall be used which may block, either temporarily or permanently, some or all e-mail sent to you through Watu Technology Website even if such e-mail does not violate the Anti-Spam Policy.
Materials you post or provide: communications monitoring
For materials you post or otherwise provide to Watu Technology website related to the Watu Technology Website you grant Watu Technology permission to Use, copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, modify, translate and reformat your Submission, each in connection with the Watu Technology Website
Liability limitation; your exclusive remedy
In no event will any Watu Technology party be liable for any damages, including without limitation any indirect, consequential, special, incidental, or punitive damages arising out of, based on, or resulting from this agreement or your use of the Watu Technology website, even if such Watu Technology party has been advised of the possibility of such damages
The exclusion of damages under this section is independent of your exclusive remedy and survives in the event such remedy fails of its essential purpose or is otherwise deemed unenforceable.
These limitations and exclusions apply without regard to whether the damages arise from
(1) Breach of contract,
(2) Breach of warranty,
(3) Negligence, or
(4) Any other cause of action, to the extent such exclusion and limitations are not prohibited by applicable law.
If you are dissatisfied with our terms/services, or do not agree with any part of this agreement, or you have any other dispute or claim with or against any Watu Technology with respect to this agreement or the Watu Technology services, then your sole and exclusive remedy is to discontinue using the Watu Technology services.
Changes to the Watu Technology website
The Watu Technology parties may change the Watu Technology website or delete features in any way, at any time and for any reason. As you use the Watu Technology website , you should expect to receive, access or use information, materials, graphics, software, data and content (collectively, “content”) originated by Watu Technology and persons other than Watu Technology (any such person is referred to as a “third party”).
You acknowledge and agree that the Watu Technology parties are not responsible or liable for
(1) Any content, including without limitation, any infringing, inaccurate, obscene, indecent, threatening, offensive, defamatory, tortuous, or illegal content, or
(2) Any third party conduct, transmissions or data.
In addition you acknowledge and agree that Watu Technology is not responsible or liable for
(1) Any viruses or other disabling features that affect your access to or use of the Watu Technology website
(2) Any incompatibility between the Watu Technology website and other website, services, software and hardware,
(3) Any delays or failures you may experience in initiating, conducting or completing any transmissions or transactions in connection with the Watu Technology website in an accurate or timely manner, or
(4) Any damages or costs of any type arising out of or in any way connected with your use of any services available from third parties though links contained on the Watu Technology website. The limitations, exclusions and disclaimers in this agreement apply to the maximum extent permitted by applicable law, and are not intended to deprive you of any mandatory protections provided to you under applicable law.
Termination:
a)Watu Technology may terminate this Agreement, or terminate or suspend your access to the Watu Technology Website at any time, with or without cause, with or without notice. Upon such termination or suspension, your right to use the Watu Technology Website will immediately cease.
b)Hosting Accounts (Emails and websites) will be terminated (contents deleted) 27 days after expiry of the domain or hosting. Upon such termination any information you have stored on the Watu Technology Servers will not be retrieved later. This shall apply to data on addon domains and sub domains if the primary/main hosting account is not renewed. It is your responsibility to check and confirm that the addon domains and its contents are backed up and transfered before you terminate the account or cancel it.
YOU HAVE LIMITED TIME TO BRING YOUR CLAIM
You and Watu Technology agree that any cause of action arising out of or related to the Watu Technology website must commence within one (1) year after the cause of action accrues. Otherwise, such cause of action is permanently barred.
Other Terms
a) Canceling A Prepaid Account
Any prepaid account cancelled within 30 days of purchase will have the remaining credit in their account refunded to them. For accounts cancelling after 30 days, refunds will only be issued at the discretion of Watu Technology
b) Domain Registrations, Transfers and change on WHOIS ( Registrant Details)
Domain registration and web hosting are two separate services. Hosting accounts do not include domain registration unless otherwise noted.Online payments are through MPESA, 2checkout.com and Paypal.com, who shall process and hold payment until the service is provided. Kenic reserves the right to refuse to register a domain without giving any reasons whatsoever. All domains transfered to Watu Technology shall not have Registrant details changed, unless you own the domain name. If a domain is transfered and you are not the owner of the domain then Watu Technology shall be notified in writing 3 days prior to any changes.( except nameserver changes)
c) Account Services
Watu Technology provides domains and web hosting services within the various limits specified by each web hosting plan.
In order to offer these services, we must at times take action to prevent some customers from interrupting or restricting services to other users.
d) Backups Policy
Watu Technology backs up all server configurations on a regular basis, however, this does not extend to backups of account web data or email. We encourage all customers to back up their web sites and databases on a regular basis, and can assist in setting up regular backup plans.
Watu Technology, will provide help and assistance, where it can, to recover any lost data (within 24 hr window), but accepts no responsibility or liability for any permanent or temporary data loss.
It is strongly advised that each customer retain a copy of each and every file before uploading it to any Watu Technology server, and to keep a safe, up to date backup at all times on their own machines. We encourage clients to take the services of Code guard
e) Log Files And Other Volatile Data
To maintain server performance, Watu Technology may, from time to time, delete any log files or temporary data from its servers. There is no set time period in which this process will take place.
Customers are advised to make copies of any log or temporary files they wish to retain.
Watu Technology accepts no responsibility or liability for loss of log or temporary files.
f) Site Statistics
Watu Technology provides access to a real-time graphical statistics application for each domain hosted. Due to the involvement of third-party components and the complexity of the links between domains, accounts and the statistics server, statistics may be unavailable from time to time. As with any other account data, Watu Technology accepts no responsibility or liability for loss of historical statistical data.
g) Bandwidth Usage / Up time
As the need arises, Watu Technology will upgrade the overall bandwidth available to accommodate the growing needs of our users. However, if any site or account produces abnormal (as decided by Watu Technology) amounts of web site, email or any other traffic, Watu Technology will take action to throttle or disable access.
If an account is found to be using excessive bandwidth, the account holder will be contacted, and required to (at the discretion of Watu Technology) either upgrade their account or pay a bandwidth usage charge as per the pricing scheme on the Watu Technology web site. Watu Technology reserves the right to cancel or suspend any account for which bandwidth usage cannot be negotiated in a reasonable (as defined by Watu Technology) period of time.
We guarantee an up time of up to 99%.
h) Web Space Usage and Hosting
Watu Technology provides web space to store files and other data with limits set by the package that is used. If an account is found to be using more than their allocated web space or resources, the account holder will be contacted and required to, at their option, reduce their used space usage or resource usage or upgrade their account. Watu Technology reserves the right to cancel or suspend any account for which web space usage cannot be negotiated in a reasonable (as defined by Watu Technology) period of time.
You shall also not use your web hosting account for archiving files, emails, media or other data as a backup service.
Please note that log files, email and database size(s) are included in your overall allowed web space, if any of these are the cause of the overage, Watu Technology will be happy to assist in deleting or otherwise reducing the overall usage of your account.
To ensure quality services we do not allow the use of more than 80% of the disk space currently used to be used for storing emails. If you require email hosting we recommend G-Suite.
i) Customer Support
It has been the goal of Watu Technology since its founding to provide top-quality customer support and satisfaction. This section clarifies our role in providing a web hosting service.
There are various features such as ASP, ODBCs, PHP, etc. that we provide to our users. Due to the complex nature of supporting such services, we are unable to support users in learning how to take advantage of them. Our support team will ensure that the settings are correct on our servers, but we may be unable to assist users in setting up their own files and applications.
At the discretion of Watu Technology, we are able to provide some advanced support services. Depending on the scale and complexity of the work, a support fee may apply, with details provided on application.
j) Web Hosting Usage
Watu Technology endeavors to provide a safe Internet environment for our users, and members of the public. As an extension of this policy, Watu Technology strictly prohibits any account hosted on our servers from containing certain types of material. These include, but are by no means limited to:
• Commercial software, made available without the consent of the copyright holder.
• Music (such as MP3s, etc.) made available without the consent of the copyright holder.
• Other material that would be illegal to distribute.
• Documentation on hacking, software piracy, counterfeiting, bomb making, etc. posted with the intent of fostering criminal activity.
• Sites promoting hate crime toward any group.
As well as any other material that would be illegal in the jurisdiction in which the web server is located, and any other material deemed unsuitable by Watu Technology. Any site hosted by Watu Technology which breaches these terms will be stopped in expectation of a site cleanup. An administrative fee may be charged in order to reactivate the site, once this cleanup has taken place.
k) .ug and tz domains
While every attempt will be made to register the domains ordered for by our customers, we shall not take responsibility when they are registered by other parties before we do so. These are offline processes takes from 24 to 36 hours.
l) Payment using Credit / Debit card / Paypal
If you are in Kenya, we advise you to make payment by cheque or MPESA paybill. If you use Credit card / Debit card or Paypal it is your responsibility to check on the amount charged at checkout point.
m) Payment and receipts
When the system sends a receipt, it only acknowledges receipt of payment, and not delivery of the service. If service is not delivered, we shall issue a refund.
n) WHOIS scripts and Domain availability
WHOIS Scripts are prone to errors since their parameters can be changed by registries (.ke, ug, tz e.t,c) hence we shall not take responsibility if our system shows that it is available, paid for but registration proves unsuccessful.
o)Hosting Data After Suspension
Business Launchpad form submissions and email
When you submit a form on the Business Launchpad website (including waitlists, demo access, orders, business validation, and feature feedback), you agree to these Terms of Use.
By submitting such a form, you also consent to receive related emails from Watu Technology. That may include confirmation codes, waitlist and launch updates, demo access details, order and account messages, and follow-up about your submission. You can ask to stop non-essential marketing or product-update emails by contacting us; transactional messages needed to complete your request or operate your service may still be sent.
Business Launchpad products (general)
Business Launchpad (launch-pad.biz and related Watu Technology storefronts) offers distinct products you may order, join a waitlist for, or try in demo form. Current and planned Launchpad products include:
- Digital Solutions Agency (DSA) — sell digital products and B2B services online
- Skill Store — sell courses, memberships, expertise, and related knowledge products
- Retail Store — sell physical goods with catalog, inventory, and checkout
- Watu FMS (Farm Management System) — farm operations, stock, projects, POS, and related farm business tools
Watu Farmers Market is a related Watu-operated marketplace platform. It is not sold as a Business Launchpad product SKU. Seller-side use of the marketplace is typically connected through a Watu FMS (or other approved) account that syncs listings and orders. Marketplace use is covered under the Watu Farmers Market section below and these Terms of Use generally.
Each Launchpad product may have its own plans, pricing, features, launch status, waitlists, demos, and service limits. Using any Launchpad product, form, demo, waitlist, or related account means you accept these Terms of Use and any product-specific terms below.
Launchpad products are provided as managed online services. Availability, features, branding, domains, and plan names may change. We may update documentation, storefronts, and fair-use limits as products evolve.
Accounts, storefronts, and related access are for lawful business use. You are responsible for your customers, content, transactions, taxes, refunds you offer, and compliance with applicable law in the markets you serve.
Paid plans renew according to the billing cycle shown at checkout (or as otherwise stated for that product). Free or promotional access, if offered, does not create a paid entitlement unless you upgrade. Fees paid for a period already started are generally non-refundable except where required by law or expressly stated at purchase.
We may suspend or terminate accounts for abuse, unpaid invoices, security risk, illegal use, or material breach of these terms. Where hosting or account data retention after suspension is described elsewhere in these Terms, that policy also applies to Launchpad products unless a product section says otherwise.
Digital Solutions Agency (DSA)
DSA includes plans such as the base DSA plan and DSA Pro, and related add-ons or campaigns when offered. Plan features, limits, and pricing are as shown on the Launchpad site and at checkout at the time of order.
DSA demo access
We may provide demo or trial access to a shared or provisioned DSA demo environment so you can evaluate the product.
- Standard demo admin access is granted for 7 days from the time access is issued (or as stated in the access email if different).
- The shared demo storefront may reset on a schedule (for example nightly). Demo data is not permanent and must not be treated as a production business.
- You may request an extension of demo access, and you may request demo access again after a prior period ends, when the demo program is open. We may approve, limit, or refuse extensions or repeat access at our discretion (for example for abuse, resource limits, or campaign rules).
- Demo credentials are personal to you for evaluation only. Do not share them publicly or use the demo for live customer sales as a production store.
DSA free / base plan inactivity
Where a DSA plan is offered at no charge (including a free forever style base plan, if available):
- The plan remains free while the account is used in line with these terms and any current plan limits.
- If there is no qualifying account activity for 3 consecutive months, we may suspend or terminate that free service and related resources.
- Qualifying activity means at least one of: signing in to the client or admin area, receiving or processing a storefront order or similar customer transaction, or other substantive use of the service we reasonably treat as active use.
- Before terminating for inactivity, we will attempt to notify you at the email on the account (for example with a warning that access may end). After suspension or termination, data retention follows our general retention / suspension policy unless we state a longer recovery window for that product.
- Inactivity termination does not apply to an active paid plan that is billed and in good standing. If you upgrade from free to paid, the paid plan’s billing and cancellation terms apply.
We may change free-plan eligibility, limits, or inactivity rules with notice through the Launchpad site, account email, or both.
Skill Store
Skill Store is a Business Launchpad product intended for selling courses, memberships, expertise, and related knowledge products through a branded skill storefront.
Until Skill Store is generally available, you may join the Skill Store waitlist or submit feedback through Launchpad forms. Waitlist signup does not guarantee launch timing, pricing, plan features, or acceptance into any early-access program.
When Skill Store launches or early access opens, plan details, pricing, demos (if any), free tiers (if any), and service limits will be as published on Launchpad and at checkout. Unless a Skill Store-specific rule is published, the Business Launchpad products (general) section and these Terms of Use apply.
If a free Skill Store plan is offered later, the same principle as DSA free plans is intended unless we publish different terms: free while active, with possible suspension or termination after 3 consecutive months without qualifying activity, after attempting email notice.
Retail Store
Retail Store is a Business Launchpad product intended for selling physical goods with catalog, inventory, and checkout capabilities.
Until Retail Store is generally available, you may join the Retail Store waitlist or submit feedback through Launchpad forms. Waitlist signup does not guarantee launch timing, pricing, plan features, or acceptance into any early-access program.
When Retail Store launches or early access opens, plan details, pricing, demos (if any), free tiers (if any), and service limits will be as published on Launchpad and at checkout. Unless a Retail Store-specific rule is published, the Business Launchpad products (general) section and these Terms of Use apply.
If a free Retail Store plan is offered later, the same principle as DSA free plans is intended unless we publish different terms: free while active, with possible suspension or termination after 3 consecutive months without qualifying activity, after attempting email notice.
Watu FMS (Farm Management System)
Watu FMS is a Business Launchpad product: a client-owned farm management system for tracking farm sections/locations, crop cycles and projects, inventory, expenses, POS, online store capabilities, and related farm-business workflows, as published for the plan you subscribe to.
Until Watu FMS is generally available on Launchpad, access may be limited to pilots, private deployments, waitlists, or demos. Signup for interest or waitlists does not guarantee launch timing, pricing, plan features, or acceptance into any program.
When Watu FMS launches or early access / ordering opens on Launchpad, plan details, pricing, demos (if any), free tiers (if any), provisioning, domains, and service limits will be as published on Launchpad and at checkout. Unless an FMS-specific rule is published, the Business Launchpad products (general) section and these Terms of Use apply.
Each Watu FMS subscription typically provisions a dedicated instance for your business (for example its own app environment and database). You are responsible for your farm data, staff accounts, customers, listings, pricing, and transactions on that instance.
Marketplace connection. Where enabled for your plan, Watu FMS may sync selected catalog items, stock, and orders with Watu Farmers Market. Syncing is optional per item/capability as offered in the product. Marketplace sales remain subject to the Watu Farmers Market section. We do not guarantee continuous sync availability; outages, delays, or rejected listings may occur.
If demo access is offered for Watu FMS, the same evaluation principles as DSA demos apply unless we state different terms in the access message: time-limited access, evaluation-only use, and extensions or repeat requests at our discretion.
If a free Watu FMS plan is offered later, the same principle as DSA free plans is intended unless we publish different terms: free while active, with possible suspension or termination after 3 consecutive months without qualifying activity, after attempting email notice.
Watu Farmers Market
Watu Farmers Market is a Watu-operated buyer/seller connector marketplace. It is not a Business Launchpad product you purchase as a Launchpad SKU. Separate accounts, apps, domains, and rules may apply as the marketplace is published.
Sellers. Farms and businesses that sell through Watu Farmers Market typically do so by connecting an approved seller system (commonly a Watu FMS instance) and opting listed items into marketplace visibility. You must keep listing details, quantities, and prices reasonably accurate. You are responsible for fulfilling marketplace orders, quality, delivery or collection arrangements you offer, refunds or disputes you agree with buyers (except where marketplace rules assign a specific process), taxes, and legal compliance for what you sell.
Buyers. Buying on Watu Farmers Market means you agree to the prices, quantities, and fulfilment terms shown for each order, and to pay using the methods offered. Availability and prices may change. We may cancel orders that cannot be fulfilled, appear fraudulent, or breach these terms.
Watu’s role. Watu provides the marketplace platform and related messaging or payment integrations we enable. Unless we expressly state otherwise for a given transaction, Watu is not the seller of farm goods listed by independent sellers, does not guarantee crop quality or delivery outcomes of third-party sellers, and is not a party to the sale contract between buyer and seller except as required to operate payments, fees, or dispute processes we publish.
We may charge marketplace fees, commissions, or subscriptions when published. We may remove listings, suspend seller or buyer access, or limit sync from seller systems for abuse, unsafe products, non-fulfilment, fraud risk, legal risk, or material breach.
Until the marketplace is generally public, access may be limited (pilot, invite, or geographic limits). Using any Farmers Market site, app, API, or connected FMS sync means you accept these Terms and any marketplace-specific rules we publish alongside the live service.
